Terms and Conditions for Online Ordering and Loyalty Program
These Terms and Conditions ( Terms ) govern your use of the online ordering system and loyalty program on the Madam Kwan's website ( the Site ) operated by Suez Top Ventures Sdn. Bhd. ( Madam Kwan's, we, us, or our ). By accessing or using the online ordering system and loyalty program, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the online ordering system and loyalty program.
1. Online Ordering Account
- To place orders through the online ordering system, you must create a user account. To participate in the loyalty program, you must register and become a member.
- You must be at least 18 years old or the age of majority in your jurisdiction to create an account and become a loyalty program member.
- By becoming a loyalty program member, you consent to receive communications related to the program, including promotional offers and updates.
- You are responsible for maintaining the confidentiality of your account and loyalty program membership information, including your username, password, and membership number.
2. Loyalty Program
- The Madam Kwan's loyalty program allows members to collect points on eligible purchases made through the online ordering system.
- Points are awarded based on the total amount spent on eligible purchases and are subject to the terms outlined in the loyalty program guidelines.
- Points are non-transferable, cannot be exchanged for cash, and are not redeemable for gift cards or vouchers.
- Madam Kwan's reserves the right to modify, suspend, or terminate the loyalty program, its rules, and point accumulation rates at any time without prior notice.
- Any abuse or fraudulent activities related to the loyalty program may result in the immediate termination of the member's account and forfeiture of accumulated points.
3. Placing Orders
- Orders placed through the online ordering system are for takeaway or delivery only. Delivery services may be subject to specific delivery areas and minimum order requirements.
- You are solely responsible for providing accurate and up-to-date delivery or pickup information, including your address and contact details.
- All orders are subject to availability. Madam Kwan's reserves the right to refuse any order, refund payments, or propose alternatives if an item is not available.
4. Payment
- Payment for orders can be made through the available payment methods provided during the checkout process. Payment must be made in full before the order is confirmed.
- All prices displayed on the Site are in Ringgit Malaysia (RM) and are inclusive of applicable taxes and charges unless otherwise stated.
- In the event of a payment processing error or payment declined by the payment gateway, Madam Kwan's shall not be liable for any resulting delay or failure in processing your order.
5. Delivery
- For delivery orders, estimated delivery times are provided for your convenience but are not guaranteed. Delays may occur due to traffic, weather, or other factors.
- Madam Kwan's will make reasonable efforts to ensure that your order is delivered within the estimated time frame. However, we shall not be liable for any loss, damage, or inconvenience caused by late delivery.
- If you are not present at the delivery address at the time of delivery, Madam Kwan's may leave the order at your doorstep or with a person at the delivery address whom you have authorized to receive the order.
6. Cancellation and Refunds
- All food and beverage items are not returnable/cancellable upon receipt of your order.
- For any incomplete, incorrect, or damaged orders, kindly contact our Customer Service Team at +603-95201079 or email accounts@madamkwans.com.my with your receipt for reference.
- Our Customer Service operates Monday-Friday 9:00 a.m.-6:00 p.m.
- Proof of purchase must be presented to our Customer Service Team upon inquiry.
- Without a receipt or any proof of purchase, we may not be able to process a replacement and/or refund.
- For incomplete orders, a refund will be issued to you via your original payment method.
- For incorrect and/or damaged items, the replacement items will be delivered to you at our expense.
- Approved refund amounts will be credited back to the customer's bank account using the original payment method within a timeframe of 2 weeks.
7. Intellectual Property
- The content, materials, and intellectual property on the Site are owned or licensed by Madam Kwan's and protected by applicable copyright, trademark, and other intellectual property laws.
- You may not reproduce, distribute, modify, or otherwise use any of the content or materials on the Site without Madam Kwan's prior written consent.
8. Limitation of Liability
- Madam Kwan's shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the online ordering system and loyalty program or any content therein.
9. Termination
- Madam Kwan's may terminate or suspend your access to the online ordering system and loyalty program at any time without notice if you violate these Terms or engage in any fraudulent, abusive, or unauthorized activities.
10. Updates and Notifications
- Madam Kwan's reserves the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Site. Your continued use of the online ordering system and loyalty program after any modifications to the Terms constitutes your acceptance of the updated Terms.

We reserve the right to reject any return, exchange, refund deemed unfit or unreasonable.
